1. Introduction and Acceptance of Terms

Welcome to Ratee. These Terms of Service ("Terms") govern your access to and use of the Ratee mobile application and services (collectively, the "Service"). By downloading, installing, accessing, or using Ratee, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the app and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

Ratee is a mobile platform that enables users to:

  • Scan product barcodes to access authentic product reviews
  • Submit and share product reviews, ratings, and images
  • Discover products through categories and hashtags
  • Connect with other users and build a community around product reviews
  • Earn points and achievements for contributing to the community

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts and Registration

To use certain features of Ratee, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Content Submission and Ownership

You retain ownership of any content you submit to Ratee, including reviews, ratings, images, and comments ("User Content"). By submitting User Content, you grant Ratee a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Service.

You represent and warrant that:

  • You own or have the right to submit the User Content
  • Your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
  • Your User Content is accurate and not misleading
  • Your User Content complies with all applicable laws and regulations

We reserve the right to remove any User Content that violates these Terms or our Community Guidelines.

5. Prohibited Conduct

You agree not to:

  • Submit false, misleading, or fraudulent reviews or ratings
  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Attempt to gain unauthorized access to any portion of the Service
  • Spam, harass, or abuse other users
  • Post content that contains viruses, malware, or other harmful code

6. Intellectual Property Rights

The Service, including its original content, features, and functionality, is owned by Ratee and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Ratee name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Ratee or its affiliates. You may not use such marks without our prior written permission.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of the Service.

7. Points, Rewards, and Achievements

Ratee may offer points, rewards, and achievements for certain activities on the platform. These are provided at our discretion and may be modified, suspended, or terminated at any time. Points and rewards have no monetary value and cannot be exchanged for cash or other consideration.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by using the account deletion feature in the app settings. Upon termination, your right to use the Service will immediately cease.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the accuracy, completeness, or usefulness of any User Content.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RATEE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Indemnification

You agree to indemnify, defend, and hold harmless Ratee and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ratee operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.
